"Reconciliation and the Straightjacket: A Comparative Analysis of the Secession Reference and R v Sparrow" argues that the Court's presuppositions about the place of Indigenous peoples and the Quebecois in the constitutional order led it to develop distinct constitutional doctrine in the response to the demands of each, and explores the basis for, and consequences of these distinct doctrinal approaches.
